简报汇编 compiled by International Service for Human Rights 由国际人权服务中心汇编   这份文件汇编了2009年出版的四个独立简报,并为翻译中文版本做了少量的修改。本汇编探讨的范围包括集会自由(1),言论自由(2),获得信息的权利(3)接触国际机构的权利(4)。该汇编汇集了保护这些权利的各种国际标准,并探讨了人权维护者行使这些权利面临的不同挑战。   另外,两个关于结社自由和获得资金的权利的简报英文版已经就绪。 本汇编文件的主要读者是在国际、区域和国家各级工作的人权维护者。这些文件旨在通过简单和通俗易懂的方式向人权维护者提供相关信息,作为帮助他们开展工作的一个实用工具。它可以用来作为一种资源或背景阅读并协助开展关于以上权利的国内倡导或意识提升。   本汇编也可以为国家人权机构(NHRIs)在处理与人权维护者相关问题时使用。它可以用来作为国家人权机构为该国制订或检讨有关接触国际机构的权利、结社自由、获取信息的权利的立法提供意见时的资源材料。   该简报还整理和引用了联合国条约机构和人权维护者处境问题联合国特别报告员维护人权维护者接触国际机构的权利的工作。学者、学生和更广泛的读者可以把本汇编作为指导,了解保护人权维护者接触国际机构的权利、结社自由和获取信息自由权利的国际标准   简报汇编 ………………………………………………………………………………………………….. 1 前言 ………………………………………………………………………………………………………… 2 简报1:集会自由 ………………………………………………………………………………………. 3 简报2:言论自由 …………………………………………………………………………………….. 12 简报3:获取信息的权利 …………………………………………………………………………….. 21 简报4:与国际机构接触的权利 …………………………………………………………………… 29   前言   该汇编涵盖人权维护者开展工作必须的四个基本权利:集会自由、言论自由、获取信息的权利和接触国际机构的权利。该分析在很大程度上依赖于人权事务委员会(Human Rights Committee (简称HRC)[1]的观察结论和人权维护者处境问题联合国特别报告员在报告和具体案例上所表达的立场。[2]相应地,在确定本汇编框架所涵盖权利时,分析主要引自公民与政治权利国际公约和个人、群体和社会机构在促进和保护普遍公认的人权和基本自由方面的权利和义务宣言(人权维护者宣言)。[3]   3国际和区域各级所有主要的人权文书承认和保护结社自由的权利。然而,尽管结社自由是被广泛承认和保护的权利,对该权利的践踏继续威胁着世界各地的人权维护者的工作。人权理事 (简称理事会)会已经认识到这一权利的重要性并在2010年设立一个和平集会和结社自由权利问题特别报告员。[4]   形成和表达意见而不用担心被压制的自由和获取信息的权利,即寻求和接受信息的权利,是自由、多元、宽容和民主的社会发展的基本信条。这两点是民主政府透明运作和公民社会有效和知情地参与的内在要求。这种自由对于人权维护者获取有关人权侵害的信息并且告知公众和政府人权侵害发生的事实,最重要的是要求问责制以及谴责不公正的法律、政策或做法来说不可或缺。   (read more…)
