中华人民共和国在本次审议(从2009年到现在)期间,在执行 《禁止酷刑和其他残忍、不人道或有辱人格的待遇或处罚公约》(公约)的有关具体条款方面基本上是失败的。没有严格落实或实施公约以及有关国内法的主要根源是一党专制的威权统治体制、缺乏法治和独立的司法系统。 中国多次在国家报告里和在2015年9月份回应酷刑委员会的“问题清单”时提到从2009年以来的立法修改,这些修改虽然有一些积极的改变,但也有许多法规改变对预防酷刑造成了负面影响。除了有一些让人鼓舞的新法规出台,而且对《刑法》和《刑事诉讼法》也做了一些正面的修改,但是,新出台的《国家安全法》,《反恐怖主义法(草案)》和其它法律草案和补充修改里面,当局同时也赋予警方巨大的权力、并允许执法人员抛开那些意在保护人权的法规。 (这些内容与《公约》第2、第11条相关)
