剥夺身患疾病的在押良心犯的医疗健康权是危及他们生命的一种酷刑。拒绝为他们提供充足的治疗违犯了中国法律的有关规定和国际人权标准,比如,《禁止酷刑和其它残忍、有损人格或非人道待遇或惩罚公约》,《公民政治权利国际公约》,以及《囚犯待遇基本原则》。 联合国《经济社会文化权利国际公约》委员会在2014年5月审议中国后得出的“结论性意见”里,对他们所获悉的剥夺在押维权人士和律师医疗健康权的情况表示关注,这种剥夺成了当局报复这些人士的一种手段;委员会要求中国保障这些人士“在任何情况下能得到充分的康复治疗”。
